www.macosch.com ("site" or “website”) is a site operated by Macosch (Elena Ivanova) ("we" or "us" or “Macosch”). We are registered in spain under number X-2445167-Z and have our registered office at C/Comtessa de Sobradiel, 9 , Barcelona, Spain.

By using the website or placing an order you accept the terms of use presented and agree to comply with them.

In the event that you does not agree with all terms of use presented here, you should not proceed with using the website.

Accessing our site as a registered user

If any information that you have provided to us is inaccurate, it is your responsibility to amend such information as soon as possible. Use the “login” button on a site to sign-in. After you are have answered all the quick and easy questions, click the “login” button and you should be all set.
We will send an email with a confirmation link to your email address. In order to complete the sign-up process, please click the confirmation link.

Orders

www.macosch.com is available for 24 hours a day, 365 days a year.

Follow these step-by-step instructions:

1. Go to our products page and choose an item.
2. Select the type of item (color, size).
3. Adding a product to your basket, click “add to cart”.
4. Continue shopping or buy your product.
5. Enter your promotional code if you have one.
6. Create an account before you buy or checkout as a guest.
7. Review your purchase.
8. Choose a payment method.
9. Click “confirm order”
10. If you select a credit or debit card as your preferred payment, after clicking the button “confirm order” you will automatically go to the payment system website. On this page you need to enter your card details (name and surname of the cardholder, card number, card’s validity period (month and year), as well as the secret code). Then click the “confirm payment” button. If the payment is approved, you will automatically return to our site, where you will see a message stating that the purchase was completed and that purchase details has been sent to your email.
    Product availability
11. You will receive an email confirming your order with all the relevant information.

Orders are subject to availability of the purchased products. Should any difficulties arise related to the shipment or availability of the products in stock, macosch reserves the right to provide the information of substitute products, of equal or superior quality and price, which the user may order as a replacement. In the event a customer does not wish to receive a substitute product, the amount paid for the original product will be refunded. Should there be a shortage of stock of a given item, macosch reserves the right to cancel an order, after notifying the customer of such cancellation.

Price

The price and conditions, along with each product’s characteristics, apply as shown on the website at the time of purchase, except in cases of obvious error. In the event of such error in the price of the product, or any other product characteristics, the customer will be notified as soon as possible and, in some cases, the order will be cancelled. These prices include vat but exclude delivery costs, which will be added to the total amount due.
Prices on this website are in euros (€).
Upon completing the purchase order and before finalizing the payment, a final summary will be provided, identifying the purchased item(s) and total price (including shipping and taxes).
Under current legislation, macosch is obliged to pass vat at the rate established by law in due course as appropriate.

Payment & security

Macosch will only accept payments via the following methods: bank transfer, credit or debit card (visa and mastercard) and paypal.

1. Bank transfer

Once you have received the web order reference number, you can transfer the money from your own bank account. Your reference number can be found in your order acknowledgement e-mail.

For bank transfers, the account number from which payment is made must be a checking account at a bank in the country from which the order was made. Any additional costs for a bank transfer will be incurred by the customer. In order to make a bank transfer, an account number will be provided to the customer in which to deposit the payment. To ensure your order is not delayed, please provide your name, surname, and web order reference number with your payment information. Before macosch can build your order, we must receive payment and clear the funds through your bank. Orders paid for by wire transfer require up to 5 business days for payment processing.

Once you have made your payment as per the instructions on our order acknowledgement email. As soon as payment has been received, we will begin to process your order.

2. Credit or debit card payment

For credit or debit card payment, the charge will be applied in real time through the payment gateway of the corresponding financial institution, once the authenticity of the provided data is verified. Macosch uses secure payment systems from leading financial institutions in e-commerce in order to provide maximum security. Confidential payment data is encrypted (ssl) and transmitted directly to the corresponding financial institution.

The cvv2, the security system used by www.macosch.com, protects all the information we receive from customers via the internet. Any information that you will be asked (including your name, address and credit card number) is encrypted via a secure server. This procedure ensures the confidentiality of your credit card information and invoice details, as it is transferred to our order processing center.

To protect any information stored on the page website, macosch uses the most advanced security systems. It is one of our main priorities to provide a secure service and protect the confidentiality of the data we receive.

3. Payment via paypal

Payment via paypal is made through the paypal payment gateway via secure payment systems. Macosch reserves the right to check the personal data provided by the customer and take any measures it considers appropriate (including cancellation of the order), in order to prevent cases of internet fraud, and to ensure that the purchased goods are delivered in accordance with the information indicated at the time of purchase.

If you want to use paypal, you must have a credit or debit card registered with paypal at www.paypal.com.

Delivery conditions

Items purchased from macosch will be delivered by a courier company.

Orders will be delivered within 3-10 business days for orders to spain and portugal. Delivery dates are estimated and are not guaranteed. Subject to stock availability, we aim to dispatch a product ordered before 7.30pm on the same working day.

We will always try to fulfil orders, but our only responsibility to you where a product is no longer available, or if we are unable to supply a particular product for whatever reason, is to make sure we do not charge you for the product.

Delivery time may vary during sales or promotional periods and/or for deliveries to areas that involve special customs. Delivery will be deemed complete upon the customer’s signing of a receipt for the products at the agreed delivery address.

In order to avoid problems with delivery (such as incorrect address, absence at time of delivery, etc.), it is imperative to complete the order form correctly. It is recommended to provide a contact telephone number where required. Orders may be tracked and viewed on our courier service’s website. The shipping cost will be showed, along with the vat of the destination country, at checkout, once the order has been placed, and before payment is due.

When a delivery is made in the canary islands, ceuta and melilla, it's important to enter your nif / cif number so that your order can be successfully delivered.

And your address doesn't include the nif / cif number, your order may be delayed in customs, or returned to macosch as undeliverable.

Shipping costs: 

* Shipping costs do not include any duties, taxes, or clearing charges levied by the destination country. These charges are the responsibility of the customer and will vary from country to country. We cannot predetermine what the charges will be. The charges may be billed directly to the customer by the destination’s customs authority. We suggest that you call your local customs office if you would like more information on customs duties in your country. Customs regulations and tax rates applicable to certain goods may change between the order date and the date of entry. In addition, classification of goods in various countries and regions may be different.

For delivery to the united states of america, you will be liable to pay for any customs and duty charges for orders over $800. Please note, the value of $800 is the total order value before promotions or discounts have been applied.

There may also be some places we cannot deliver to.

Unfortunately we cannot ship to any overseas departments and territories of the following countries: the channel islands, the isle of man, the isle of wight, canary islands, campione d'italia, città del vaticano, livigno, san marino, büsingen am hochrhein, helgoland, greenland and the faroe islands. Any order addressed to these locations will be cancelled.

Exchanges & returns

Exchanges

Door-to-door size exchange

If you are unsatisfied with the size of an item once you’ve received it, macosch offers you the option of exchanging the size at your address in a term of 14 days. These terms are valid as of the date on which you receive the order, provided that the garment has not been used or damaged. Jewelry cannot be exchanged.

Items cannot be exchanged for other articles or the same item in a different color. The same reference may only be exchanged for another size. In order to exchange an item for another article, you must first return it and then proceed to purchase the item you wish. The size exchange service will be limited to a single exchange per order and can include as many items in the order as necessary.

How to proceed:

1. Contact support service by:
   A) sending an e-mail to info@macosch.com,
   B) or enter to the support service page on the site www.macosch.com and leave a message in order to request a pick-up for the article(s) you wish to exchange.
2. Our agents will inform you of the size availability and send a courier to your address or office at the scheduled time, at no cost for you.
3. Return the article(s) for which you’d like a different size in the original packaging.
4. Our courier service will carry out the exchange of the article and provide you with the new size within the established time period.

Returns

You may exchange or return any article you purchase that is not to your complete satisfaction. You have a maximum period of 14 days from the date of delivery to notify us and return the unwanted item(s). Due to hygiene reasons, earrings may not be returned nor exchanged. Gift packs are indivisible and their items may not be returned separately.

It will not incur any return fees. However, we can withhold the refund until the goods have been received back or until a valid evidence of the return is provided, depending on which condition is met first.

Your right to cancel the contract shall apply exclusively to products that are returned in the same condition as you received them.

Request a pick-up:

A courier service will collect the items you wish to return free of charge.

How to proceed:

1. Contact support service by sending an e-mail to servicio@macosch.com in order to request a pick-up for the article(s) you wish to return.
2. Once your returns request has been confirmed, our courier service will contact you to schedule a day and time for pick-up that best suits your needs.
3. Pack your items:
   Please remember to return all items in their original state and packaging, include this completed form in the package, and seal the box securely along with the security sticker provided.
4. Hand over the package to the courier:
   Hand over the sealed package with your return(s) to the courier.

Refunds

If you have paid for your order by bank transfer the number of the account where you would like to receive the refund must be indicated on the returns form.

The refund will be made into your bank account (if you have paid bank transfer) or your bank card (if you have paid by credit card, debit card or paypal). Due to the administrative process of this method, the full reimbursement will take place in a timeframe of approximately 14 business days.

Right of withdrawal

The customer has the right to withdraw from the present contract within 14 calendar days without any need to give reasons.

The withdrawal period expires 14 calendar days from the date of purchase. The right of withdrawal does not apply to underwear whose safety seal has been broken after dispatch.

To exercise the right to withdraw, you must notify us of your decision to withdraw from the contract through an unequivocal declaration at or e-mail: info@macosch.com.

To comply with the withdrawal deadline, the notification in which you exercise your right to withdrawal simply needs to be sent before the corresponding deadline expires.

Consequences of withdrawal

In the case of withdrawal, we will refund the customer all the payments received after purchase, including the delivery expenses (with the exception of additional expenses arising from a decision by the customer to choose a delivery mode other than the least expensive ordinary delivery we offer) without undue delay and in all cases within 14 days of the date on which we are notified of the decision to withdraw from the present contract. We will process said refund using the same payment method used by the customer in the initial transaction, unless the customer has expressly stated otherwise. Under no circumstances will the customer incur any expense as a consequence of the refund.

We may withhold the refund until the goods have been received, or until the customer has presented evidence of their return, whichever condition occurs first.

The customer must return or deliver the goods directly without any undue delay and within 14 days of the date on which we are notified of the decision to withdraw from the contract. The deadline will be deemed complied with if the goods are returned before expiry of said deadline.

In order to proceed with the return of goods, customers can use the services which macosch places at their disposal, such as: free returns to stores or free home collection.

Purchase warranty

The legal guarantee of the products offered by macosch is established in royal decree 1/2007 of 16 november, approving the revised text of the general law for the protection of consumers and users.

Macosch will be liable for any lack of conformity of products that become apparent within two years from delivery.

The products offered on this website have been selected from the macosch collection and therefore they maintain the same quality status and warranty as the items on sale in other establishments.

Each season, macosch photographs all items on sale to show them as authentically as possible. However, items may be subject to minor variations depending on the color calibration of your monitor.

Jurisdiction and applicable law

The spanish courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these terms of use in your country of residence or any other relevant country.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of spain.

Privacy policy

Macosch takes your privacy very seriously and treats all your personal information as confidential. This privacy policy sets out how we treat your personal information and what we use it for. These terms apply whether you contact us through our website, promotion or any other channel.

When you place an order or set up an account through one of our websites, we will collect your name, billing address, delivery address, contact details (including email and telephone numbers), gender and password. We will also keep details of all of your orders. We will collect information about your use of our website. We do not hold your payment card details. Financial transactions take place directly and securely with our payment provider.

If you have opted in to receive marketing communications from us, we will use your personal data to notify you of macosch products, promotions, competitions and special offers that may be of interest to you.
